Keeping registered protection alive

A Philippine trademark registration lasts ten years from the registration date and can be renewed for further ten-year periods for as long as the mark stays in use. Renewal is not automatic. A request must be filed with IPOPHL within the window the rules allow before expiry, and a late request is possible only within a grace period after expiry, with a surcharge. Once that grace period passes, the registration is gone.

Renewal sits alongside the Declaration of Actual Use obligations, which continue through the life of the registration, including after renewal. Changes of owner, company name or address should be recorded before renewal so the request matches the register. If you are still within the grace period, a late renewal can be filed with a surcharge. Once the grace period has passed, the registration generally cannot be renewed and a fresh application is needed, with the risk that someone else has filed in the meantime.
